TERMS AND CONDITIONS OF TRADING
The following Terms of Use is a legal contract between an individual user and Southmark.
- In these conditions of sale, “the Supplier” means F&M Agencies (Reg no 1988028263/23) trading as SOUTHMARK, “the Customer” means the Buyer of goods and/or services from the Supplier;
- The Customer may be subject to a credit check;
- Conditions of payment is strictly 30 days from date of statement;
- The Customer undertakes to make payment for all purchases within THIRTY (30) calendar days net of the date of the statement;
- In the event of debt collection the Customer shall be liable for all legal costs as between attorney and client, as well as collection of commission and tracing costs should it become necessary for legal action to be taken for the recovery of any amounts owing arising out of purchases made, services rendered and/or interest levied on overdue amounts;
- Interest on outstanding accounts will be levied at the current repo rate plus 2% (two percent).
- All quotations provided by the Supplier and orders made by the Customer for supply by the Supplier for goods or services are on the basis of these Terms and Conditions only;
- Quotations supplied by the Supplier to the Customer shall remain valid for 14 calendar days from date of quotation;
- Prices quoted are exclusive of value-added tax (VAT), which will be added at the rate prevailing on the date of the invoice.
- All orders for goods and/or services need to be presented by the Customer to the Supplier in writing and, upon receipt of said order by the Supplier, may not be cancelled or withdrawn without the Supplier’s prior written consent.
- No discounts or allowances other than that which may be shown on the Supplier’s invoice may be deducted. Any settlement discounts granted at the Supplier’s discretion to the Customer will be forfeited if the Customer omits to make payment in full to the Supplier by due date.
- All products delivered will remain the property of Southmark until such time full payment has been received.
- All Errors and Omissions are Excluded from the Terms and Conditions.
